Answer View answer ▾

Answer: Option C — Indian Forest Act, 1878

Detailed Solution

The Indian Forest Act, 1927 consolidated earlier forest laws and replaced the Indian Forest Act, 1878.

History of forest laws in British India:

  • The first Indian Forest Act was passed in 1865, giving the government control over forests.
  • The Indian Forest Act, 1878 replaced the 1865 Act and divided forests into reserved forests, protected forests and village forests.
  • The Indian Forest Act, 1927 was enacted to consolidate the law relating to forests, the transit of forest produce and the duty on timber.

Main provisions of the 1927 Act:

  • The government can declare an area a reserved forest, a protected forest or a village forest.
  • In reserved forests, most activities, such as hunting, grazing and cutting trees, are prohibited unless permitted.
  • In protected forests, some activities are allowed, but the government can regulate them.
  • Village forests are managed by village communities.
  • It regulates the transit of timber and other forest produce and allows the government to levy duties.
  • It lays down penalties for forest offences.

Criticism of colonial forest laws:

  • They were designed mainly to give the colonial government control over timber and revenue.
  • They took away the traditional rights of forest-dwelling communities and tribals.

The 2017 amendment:

The Act was amended in 2017 to exclude bamboo grown in non-forest areas from the definition of "tree", so that farmers could grow and sell bamboo freely.

Post-independence forest laws:

  • The Wildlife (Protection) Act protects wild animals and plants.
  • The Forest (Conservation) Act restricts the use of forest land for non-forest purposes without the Centre's approval.
  • The Forest Rights Act, 2006 recognises the rights of Scheduled Tribes and other traditional forest dwellers.
  • The Compensatory Afforestation Fund Act, 2016 deals with funds for afforestation.

Forests in the Constitution:

Forests were moved from the State List to the Concurrent List by the 42nd Amendment.

Why not the other options?

  • ✗The Forest Conservation Act, the Biological Diversity Act and the Forest Rights Act were passed after independence and did not precede the 1927 Act.

Quick tip

Remember: Indian Forest Acts: 1865 → 1878 → 1927 (still in force, amended in 2017).

Environmental Conventions, Laws & Organisations — Preparation

This question tests your understanding of Environmental Conventions, Laws & Organisations, a key topic in the General Knowledge section. The detailed solution above uses a step-by-step approach to show the reasoning, and where available, a shortcut that helps you solve similar questions in under 90 seconds during the actual exam.

This topic covers international environmental agreements, such as the Montreal Protocol, the Kyoto Protocol, the Paris Agreement, the Ramsar Convention and the Convention on Biological Diversity, Indian environmental laws, and environmental organisations and movements such as the Chipko movement. Questions usually ask what an agreement deals with (the Montreal Protocol protects the ozone layer, and the Ramsar Convention protects wetlands), when India passed an environmental law (such as the Environment Protection Act 1986), and who led a movement (Sunderlal Bahuguna is associated with the Chipko movement). Climate summit outcomes change every year, so check current affairs. Practise the environmental conventions and laws questions below, written in the style of the general awareness sections of exams such as SSC, banking, railways, CUET GAT, MAH CET and CLAT. Each question comes with a detailed explanation that adds related facts, so every question helps you revise more than one point.
