Detailed Solution

Article 129 provides that the Supreme Court shall be a court of record and shall have all the powers of such a court, including the power to punish for contempt of itself.

Meaning of a court of record:

  • The judgments, proceedings and acts of the Supreme Court are recorded for perpetual memory and testimony.
  • These records have evidentiary value and cannot be questioned when produced before any court.
  • They are recognised as legal precedents and legal references.

Power to punish for contempt:

  • The Supreme Court can punish for contempt of itself, with simple imprisonment for up to six months, or a fine of up to two thousand rupees, or both, under the Contempt of Courts Act.
  • It has also held that it can punish for contempt of lower courts and tribunals.

Kinds of contempt:

  • Civil contempt: wilful disobedience of any judgment, order or direction of a court, or wilful breach of an undertaking given to a court.
  • Criminal contempt: publication or act that scandalises or lowers the authority of a court, interferes with judicial proceedings, or obstructs the administration of justice.

Limits on contempt:

Innocent publication, fair and accurate reporting of judicial proceedings, and fair criticism of judicial acts are not contempt.

Important cases:

Other features of the Supreme Court:
