What is the minimum age required to contest elections to a Panchayat?

Answer View answer ▾

Answer: Option A — 21 years

Detailed Solution

Under Article 243F of the Constitution, a person shall be disqualified from being a member of a Panchayat if he or she is disqualified under any law for the time being in force for the purposes of elections to the state legislature, or under any law made by the state legislature. However, the Article specifically provides that no person shall be disqualified on the ground that he or she is less than 25 years of age, if he or she has attained the age of 21 years.

In simple terms, the minimum age for becoming a member of a Panchayat is 21 years, while it is 25 years for the state Legislative Assembly. The same rule applies to municipalities under Article 243V. Disqualification questions are decided by an authority set by the state legislature.

Some states have added further qualifications through their Panchayati Raj Acts, such as minimum educational qualifications (introduced by states like Haryana and Rajasthan at times), having a functional toilet at home, or not having more than two children. The Supreme Court upheld Haryana's educational criteria in the Rajbala case (2015).

The minimum ages for other offices are:

  • Voter: 18 years (reduced from 21 by the 61st Amendment, 1988).
  • Member of Lok Sabha or state Legislative Assembly: 25 years.
  • Member of Rajya Sabha or state Legislative Council: 30 years.
  • President, Vice-President or Governor: 35 years.
  • Panchayat or municipality member: 21 years.

The 73rd Constitutional Amendment Act, 1992 added Part IX (Articles 243 to 243O) and the Eleventh Schedule, with 29 subjects, to the Constitution. It came into force on 24 April 1993, now celebrated as National Panchayati Raj Day. It provided for a three-tier system (village, intermediate and district levels), direct elections, reservation for SCs and STs in proportion to population and at least one-third for women, a five-year term, State Election Commissions and State Finance Commissions. Many states, such as Bihar (the first, in 2006), have raised women's reservation to 50%.

Why not the other options?

  • ✗18 years is the minimum age for voting.
  • ✗25 years is the minimum age for the Lok Sabha and Legislative Assemblies.
  • ✗30 years is the minimum age for the Rajya Sabha and Legislative Councils.

Quick tip

Remember: Panchayat member = 21 years (Article 243F); voter = 18; Lok Sabha and Assembly = 25; Rajya Sabha and Council = 30; President = 35. 73rd Amendment in force 24 April 1993.
