Answer View answer ▾

Answer: Option C — Deputy Speaker of the Lok Sabha

Detailed Solution

Under Article 94, the Speaker may resign his office by writing under his hand addressed to the Deputy Speaker. Similarly, the Deputy Speaker may resign by writing addressed to the Speaker.

Vacating the office:

  • The Speaker vacates his office if he ceases to be a member of the Lok Sabha.
  • He may resign by writing to the Deputy Speaker.
  • He may be removed by a resolution of the Lok Sabha passed by a majority of all the then members of the House.

Removal procedure:

  • At least 14 days' advance notice must be given of the intention to move such a resolution.
  • While the resolution for his removal is under consideration, the Speaker cannot preside, though he can be present and speak.
  • In that situation, he can vote in the first instance but not in the case of an equality of votes.

Continuation after dissolution:

  • When the Lok Sabha is dissolved, the Speaker does not vacate his office immediately.
  • He continues until immediately before the first meeting of the newly elected Lok Sabha.

Why the Speaker resigns to the Deputy Speaker:

  • The Speaker and Deputy Speaker are both officers of the House, elected by it.
  • The Constitution keeps their resignations within the House, so that the executive has no role.

Election of the Speaker and Deputy Speaker:

  • The Lok Sabha elects the Speaker from among its members as soon as possible after its first sitting.
  • The date of the Deputy Speaker's election is fixed by the Speaker.

Similar provisions for state legislatures:

Under Article 179, the Speaker of a state Legislative Assembly addresses his resignation to the Deputy Speaker, and the Deputy Speaker to the Speaker.

Rajya Sabha:

The Deputy Chairman of the Rajya Sabha resigns by writing to the Chairman.

Why not the other options?

  • ✗The President, the Prime Minister and the Chairman of the Rajya Sabha do not receive the Speaker's resignation.

Quick tip

Remember: Speaker resigns to the Deputy Speaker, and the Deputy Speaker resigns to the Speaker (Article 94).
