Answer: Option D — Article 166
Detailed Solution
Article 166 deals with the conduct of business of the Government of a State.
What Article 166 provides:
- All executive action of the Government of a State shall be expressed to be taken in the name of the Governor.
- Orders and other instruments made in the name of the Governor shall be authenticated as laid down in rules made by the Governor.
The Governor shall make rules for the more convenient transaction of the business of the Government of the State, and for the allocation of this business among the Ministers, in so far as it is not business with respect to which the Governor is required to act in his or her discretion.
The Rules of Business:
- Each state government has its "Rules of Business", made by the Governor under this Article.
- These rules decide which department deals with which subject, and which matters must be placed before the Council of Ministers.
Meaning of the provision:
- Although the Governor is the formal head of the state executive, the real power is exercised by the Chief Minister and the Council of Ministers.
- The use of the Governor's name is a formal requirement, which shows the constitutional position of the Governor.
Related provisions on the state executive:
- Article 154 vests the executive power of the State in the Governor, to be exercised directly or through officers subordinate to him or her.
- Article 163 provides for a Council of Ministers, with the Chief Minister at its head, to aid and advise the Governor, except in matters where the Governor acts in his or her discretion.
- Article 167 lays down the duty of the Chief Minister to communicate to the Governor all decisions of the Council of Ministers relating to the administration of the State, and to furnish information when asked.

- Articles 154, 163 and 167 deal with other aspects of the state executive, as explained above.
