Answer: Option C — Members of the Legislative Council
Detailed Solution
Article 182 provides that the Legislative Council of every state having such a Council shall, as soon as may be, choose two of its members to be its Chairman and Deputy Chairman.
Vacating, resignation and removal:
- Under Article 183, the Chairman or Deputy Chairman vacates office if he ceases to be a member of the Council.
- The Chairman may resign by writing to the Deputy Chairman, and the Deputy Chairman by writing to the Chairman.
- Either of them may be removed by a resolution of the Council passed by a majority of all the then members, after 14 days' notice.
Powers of the Chairman:
- He presides over the meetings of the Council.
- He maintains order and decorum.
- He interprets the rules of procedure.
- He decides questions of disqualification of members on the ground of defection under the Tenth Schedule.
- He has a casting vote in case of a tie.
Difference from the Rajya Sabha:
- In the Rajya Sabha, the Chairman is not elected by the House; the Vice-President of India is the ex officio Chairman.
- In a Legislative Council, both the Chairman and the Deputy Chairman are elected by the members from among themselves.
Comparison with the Assembly:
The Legislative Assembly elects its own Speaker and Deputy Speaker under Article 178.
Who presides when both are absent:
A person determined by the rules of procedure of the Council, or by the Council itself, presides.
Importance of the office:
- The Chairman protects the rights and privileges of the Council and its members.
- He represents the Council in its dealings with the Assembly and the government.
Why not the other options?
- ✗The Governor, the Assembly members and the Chief Minister do not choose the Chairman of the Council.
Quick tip
Remember: Legislative Council Chairman and Deputy Chairman are elected by the Council's own members (Article 182).
