Along with the elected members of Parliament and state Legislative Assemblies, the elected members of which Union Territory assemblies vote in the election of the President?

Answer View answer ▾

Answer: Option C — Delhi and Puducherry

Detailed Solution

Under Article 54 of the Constitution, the President of India is elected by an electoral college consisting of:

The elected members of both Houses of Parliament (Lok Sabha and Rajya Sabha).

The elected members of the Legislative Assemblies of the states.

The elected members of the Legislative Assemblies of the Union Territories of Delhi and Puducherry.

The Union Territories of Delhi and Puducherry were added to the electoral college by the 70th Constitutional Amendment Act, 1992 (with effect from 1 June 1995). The Union Territory of Jammu and Kashmir, created in 2019, also has a Legislative Assembly; under the Jammu and Kashmir Reorganisation Act, 2019, its elected MLAs are also counted in the electoral college for the presidential election.

Not included in the electoral college:

  • Nominated members of both Houses of Parliament.
  • Nominated members of state Legislative Assemblies.
  • Members of state Legislative Councils (both elected and nominated).

The election is held in accordance with the system of proportional representation by means of the single transferable vote, and the voting is by secret ballot. The value of the votes of MLAs varies from state to state, based on the population of the state (1971 Census), so that there is uniformity among states and parity between the states as a whole and the Union.

The President holds office for five years and is eligible for re-election (Article 57). The minimum age is 35 years (Article 58). Disputes relating to the election are decided by the Supreme Court (Article 71).

Dr Rajendra Prasad was the first President (1950-62) and the only one elected twice. Droupadi Murmu, elected in 2022, is the 15th President and the first tribal woman to hold the office; Pratibha Patil (2007) was the first woman President.

The Vice-President is elected by both Houses of Parliament (including nominated members), not by state legislators.

Why not the other options?

  • ✗Chandigarh, Ladakh and Lakshadweep do not have legislative assemblies.

Quick tip

Remember: Presidential electoral college = elected MPs + elected MLAs of states + elected MLAs of Delhi and Puducherry (70th Amendment, 1992); nominated members and MLCs excluded; disputes to the Supreme Court (Article 71).
