Answer View answer ▾

Answer: Option C — Second Schedule

Detailed Solution

The Second Schedule of the Constitution contains provisions relating to the emoluments, allowances, privileges and other matters of certain high constitutional office-holders.

Office-holders covered by the Second Schedule:

  • The President of India.
  • The Governors of States.
  • The Speaker and the Deputy Speaker of the Lok Sabha.
  • The Chairman and the Deputy Chairman of the Rajya Sabha.
  • The Speaker and the Deputy Speaker of the Legislative Assemblies of the States.
  • The Chairman and the Deputy Chairman of the Legislative Councils of the States.
  • The judges of the Supreme Court.
  • The judges of the High Courts.
  • The Comptroller and Auditor-General of India.

How the salaries are fixed:

  • The Second Schedule originally gave the actual amounts of the salaries.
  • Now, most of these salaries are fixed by laws passed by Parliament, and the Schedule refers to these laws.
  • The salaries of many of these office-holders are charged on the Consolidated Fund of India or of the State, which means that they are not voted on by the legislature every year.
  • Their salaries cannot normally be reduced to their disadvantage during their term of office, to protect their independence.

Why these offices are protected:

  • The President, the Governors, the presiding officers, the judges and the CAG must be able to work without fear or favour.
  • If their salaries could be changed easily by the government of the day, their independence and neutrality might be affected.
  • The Second Schedule, together with the provisions on charged expenditure, gives them financial security.

The Schedules of the Constitution:

  • The Constitution now has twelve Schedules, which contain lists, forms and details that support the main Articles.
  • The original Constitution had eight Schedules; four were added later.

Why not the other options?

  • ✗The Eighth Schedule lists the languages; the Ninth Schedule protects certain laws; the Tenth Schedule deals with anti-defection.

Quick tip

Remember: Second Schedule = emoluments and allowances of the President, Governors, Speakers, Chairmen, judges and the CAG.
