Contracts entered into in the name of another person without authority or without legal representation is ______.

Answer View answer ▾

Answer: Option C — unenforceable contract

Detailed Solution

A person who contracts in another's name without authority cannot bind that other person; the contract cannot be enforced against him unless he ratifies it.

Such contracts are classed as unenforceable contracts: they exist but cannot be enforced in court as they stand.

They are not void from the start (ratification can cure them) and not voidable (no free-consent defect is involved).
