Answer (Detailed Solution Below)View answer ▾Hide ▴
Answer: Option B — Either House of Parliament
Detailed Solution
Under Article 61, the impeachment proceedings against the President can be started in either House of Parliament, the Lok Sabha or the Rajya Sabha.
Procedure in outline:
- The charges are framed in the form of a resolution in the House where the process begins.
- The resolution can be moved only after advance notice in writing has been given to the President.
- Once the House that starts the process passes the resolution by the special majority required, the charges are sent to the other House.
The other House investigates the charges. The President has the right to appear and to be represented at the investigation.
If the other House also passes a resolution by the required special majority, sustaining the charges, the President stands removed from office from the date on which the resolution is passed.
Nature of the process:
- It is a quasi-judicial procedure carried out by Parliament.
- Both Houses play an equal role, unlike in ordinary legislation.
Who takes part:
- Elected members and nominated members of both Houses take part in the impeachment.
- Elected members of the state legislative assemblies and of the Legislative Assemblies of Delhi and Puducherry do not take part, even though they take part in electing the President.
Source of the provision:
- The idea of impeaching the head of state was borrowed from the Constitution of the United States.
- In the United States, the House of Representatives impeaches and the Senate tries the President, but in India either House can do either role.
History:
No President of India has ever been impeached.
Other officials removed by a similar process:
- The Vice-President is removed by a different procedure, started only in the Rajya Sabha.
- Judges of the Supreme Court and High Courts are removed by a process in Parliament under Article 124(4), which is also commonly called impeachment.
Why not the other options?
- ✗There is no joint sitting for impeachment.
- ✗Good to know
- ✗The process is not limited to one particular House.
Quick tip
Remember: Presidential impeachment (Article 61) can start in either House; the other House investigates.
