Answer View answer ▾

Answer: Option B — Rigidity and flexibility

Detailed Solution

The Indian Constitution is described as a unique blend of rigidity and flexibility, because some parts of it can be amended easily while others need a more difficult procedure.

Rigid and flexible constitutions:

  • A rigid constitution is one that requires a special procedure for its amendment, such as the Constitution of the USA.
  • A flexible constitution is one that can be amended in the same way as ordinary laws are made, such as the British Constitution.
  • The Indian Constitution is neither very rigid nor very flexible.

Three methods of amendment in India:

By a simple majority of Parliament: some provisions, such as the admission or establishment of new states, the creation or abolition of legislative councils in states, and changes in the names and boundaries of states, can be changed by a simple majority, like ordinary laws; such changes are not considered amendments under the formal amendment procedure.

By a special majority of Parliament: most provisions, such as the Fundamental Rights and the Directive Principles, can be amended by a majority of the total membership of each House and a two-thirds majority of the members present and voting.

By a special majority of Parliament and the consent of half of the state legislatures: some provisions that affect the federal structure, such as the election of the President, the Supreme Court and High Courts, the distribution of legislative powers, and the representation of states in Parliament, need the ratification of at least half of the states.

Limits on amendment:

In the Kesavananda Bharati case, the Supreme Court held that Parliament cannot amend the "basic structure" of the Constitution.

Nehru's view:

Nehru said in the Constituent Assembly that the Constitution should be solid and permanent, but also flexible enough to meet the needs of a changing society.

Why not the other options?

  • ✗The Indian Constitution is not described as a blend of unitary and presidential features, of monarchy and republic, or of written and unwritten parts only.

Quick tip

Remember: Indian Constitution = blend of rigidity and flexibility (simple majority, special majority, and special majority plus ratification by half the states).
