Answer View answer ▾

Answer: Option D — Article 69

Detailed Solution

Article 69 provides that every Vice-President, before entering upon his office, shall make and subscribe an oath or affirmation before the President, or some person appointed by him.

Contents of the oath:

  • The Vice-President swears to bear true faith and allegiance to the Constitution of India as by law established.
  • He swears to faithfully discharge the duty upon which he is about to enter.

Difference from the President's oath:

  • The President's oath under Article 60 is administered by the Chief Justice of India, or in his absence the senior-most judge of the Supreme Court.
  • The President swears to preserve, protect and defend the Constitution and the law, and to devote himself to the service and well-being of the people of India.
  • The Vice-President's oath is simpler, because he does not head the executive.

Oaths of other officials:

  • Ministers take an oath of office and an oath of secrecy before the President (Article 75 and the Third Schedule).
  • Members of Parliament take an oath before the President or a person appointed by him (Article 99).
  • Judges of the Supreme Court take an oath before the President or a person appointed by him (Article 124).

The Third Schedule:

  • The forms of oath or affirmation for ministers, members of legislatures, judges and the Comptroller and Auditor General are given in the Third Schedule.
  • The oaths of the President and the Vice-President are given in the Articles themselves, not in the Third Schedule.

Other Articles on the Vice-President:

  • Article 63 creates the office.
  • Article 64 makes him ex officio Chairman of the Rajya Sabha.
  • Article 66 deals with his election.
  • Article 67 deals with his term.

Importance of oaths:

Oaths bind holders of constitutional offices to uphold the Constitution.

Why not the other options?

  • ✗Article 60 deals with the President's oath.
  • ✗Article 75 deals with ministers.
  • ✗Article 99 deals with the oath of members of Parliament.

Quick tip

Remember: Article 60 = President's oath (before the CJI); Article 69 = Vice-President's oath (before the President).
