To start impeachment proceedings against the President of India, the notice containing the charges must be signed by at least:

Answer View answer ▾

Answer: Option D — One-fourth of the members of the House concerned

Detailed Solution

Under Article 61, impeachment charges against the President can be brought only if a resolution containing the proposal is moved after at least 14 days' written notice, signed by at least one-fourth of the total number of members of the House that begins the proceedings.

Steps in the impeachment process:

  • A resolution is moved in either House, after 14 days' notice signed by one-fourth of its members.
  • The resolution must be passed by the House by the required special majority of its total membership.
  • The charges are then investigated by the other House.
  • The President has the right to appear and to be represented during the investigation.
  • If the other House also passes the resolution by the required special majority, declaring that the charges have been sustained, the President stands removed from that date.

Why a high threshold is needed:

  • The President is the head of the State and the symbol of the nation.
  • A high threshold for starting the process prevents frivolous or politically motivated attempts to remove him.

Both Houses play an equal role:

  • Unlike ordinary legislation, both Houses have equal powers in impeachment.
  • Either House can frame the charges, and the other investigates.

Who takes part:

  • Both elected and nominated members of Parliament take part in the impeachment.
  • Members of state legislative assemblies do not take part, although they take part in electing the President.

History:

No President of India has ever been impeached.

Comparison with other officials:

The Vice-President is removed by a resolution of the Rajya Sabha, agreed to by the Lok Sabha, after 14 days' notice.

Why not the other options?

  • ✗One-tenth is the quorum of a House, not the requirement for the notice.
  • ✗One-third of both Houses and half of the Lok Sabha are not provided in the Constitution.

Quick tip

Remember: Impeachment notice = 14 days' notice + signatures of one-fourth of the members of the House that starts it.
