Which landmark judgment declared the Right to Privacy as a fundamental right under the Indian Constitution?

Answer View answer ▾

Answer: Option B — K.S. Puttaswamy vs. Union of India (2017)

Detailed Solution

In Justice K. S. Puttaswamy (Retd.) v. Union of India (24 August 2017), a nine-judge bench unanimously held privacy to be a fundamental right under Article 21 and Part III.

Kesavananda Bharati (1973) gave the basic structure doctrine; Maneka Gandhi (1978) widened Article 21 to 'fair, just and reasonable' procedure; Golaknath (1967) dealt with amending Fundamental Rights.

Quick tip

Remember: Privacy = Puttaswamy 2017 (9 judges); Basic structure = Kesavananda 1973.
