Answer View answer ▾

Answer: Option D — Article 58

Detailed Solution

Article 58 lays down the qualifications for election as President of India.

Qualifications under Article 58:

  • The person must be a citizen of India.
  • The person must have completed the age of 35 years.
  • The person must be qualified for election as a member of the Lok Sabha (House of the People).
  • The person must not hold any office of profit under the Government of India, a State government, or any local or other authority under the control of these governments.

Offices not treated as offices of profit:

A sitting President or Vice-President, the Governor of any State, and a Minister of the Union or of a State are not considered to hold an office of profit for this purpose; so they can contest the election.

Conditions for nomination:

  • Under the Presidential and Vice-Presidential Elections Act, 1952, a candidate's nomination must be supported by at least 50 electors as proposers and 50 electors as seconders.
  • The candidate must make a security deposit of 15,000 rupees in the Reserve Bank of India.
  • These conditions were introduced in 1997 to discourage frivolous candidates.

Other provisions on the President:

  • Article 52: There shall be a President of India.
  • Article 54: The President is elected by an electoral college of the elected members of both Houses of Parliament and the elected members of the State Legislative Assemblies.
  • Article 55: The manner of election, by proportional representation by means of the single transferable vote.
  • Article 56: The term of office is five years.
  • Article 57: The President is eligible for re-election.
  • Article 60: The oath of the President is administered by the Chief Justice of India.
  • Article 61: Impeachment of the President.

Why not the other options?

  • ✗Article 54 deals with the election of the President; Article 56 with the term of office; Article 60 with the oath.
