Answer View answer ▾

Answer: Option A — November 2013

Detailed Solution

The NOTA option was first used in the Assembly elections held in November and December 2013 in Chhattisgarh, Mizoram, Rajasthan, Madhya Pradesh and Delhi.

How NOTA was introduced:

In the People's Union for Civil Liberties (PUCL) v. Union of India case, decided on 27 September 2013, the Supreme Court directed the Election Commission to provide a NOTA button on Electronic Voting Machines and ballot papers.

The Court held that the right to vote includes the right to reject all candidates, as part of freedom of expression under Article 19(1)(a).

It said that NOTA would encourage voters to participate and would put pressure on parties to field better candidates.

How NOTA works:

  • NOTA is the last option on the EVM.
  • A voter who does not want to vote for any candidate can press the NOTA button, and his vote remains secret.

Effect of NOTA on results:

  • Votes cast for NOTA are counted, but they do not affect the result.
  • Even if NOTA gets the highest number of votes, the candidate with the most votes among the contestants is declared elected.
  • So NOTA is not a "right to reject" in the full sense.

Lok Sabha elections:

NOTA was available in a Lok Sabha general election for the first time in 2014.

Use in other elections:

  • NOTA is available in elections to the Lok Sabha, state assemblies and local bodies in many states.
  • In 2018, the Supreme Court held that NOTA cannot be used in Rajya Sabha elections, which are indirect elections.
  • Some State Election Commissions, such as Maharashtra's, have ordered fresh elections if NOTA gets the most votes in local body elections.

Importance:

NOTA allows voters to express dissatisfaction with all candidates without abstaining.

Why not the other options?

  • ✗May 2009 and February 2012 are before the Supreme Court's judgment.
  • ✗May 2014 is the first Lok Sabha election with NOTA.

Quick tip

Remember: NOTA = PUCL judgment (27 September 2013); first used in Assembly polls of November 2013; first Lok Sabha use in 2014.
