Answer View answer ▾

Answer: Option D — Parliament

Detailed Solution

Under Article 75(6), the salaries and allowances of ministers, including the Prime Minister, are determined by Parliament from time to time by law. Until Parliament does so, they were to be as specified in the Second Schedule.

Law made by Parliament:

  • Parliament passed the Salaries and Allowances of Ministers Act, 1952, which has been amended from time to time.
  • The Prime Minister receives the same salary and allowances as a member of Parliament, plus a sumptuary allowance, free accommodation, travel and other facilities.
  • Ministers of different ranks receive different sumptuary allowances.

Who pays:

Salaries of ministers are paid out of the Consolidated Fund of India, but they are voted by Parliament, not charged expenditure.

Salaries of other high officials:

  • President: salary determined by Parliament by law and charged on the Consolidated Fund of India; it cannot be reduced during his term.
  • Vice-President: receives salary as Chairman of the Rajya Sabha, as fixed by Parliament.
  • Members of Parliament: salary determined by Parliament under Article 106.
  • Judges of the Supreme Court: determined by Parliament under Article 125 and charged on the Consolidated Fund.

Changes during COVID-19:

In 2020, Parliament passed laws to reduce the salaries of ministers and MPs by 30 per cent for one year, to help fight the pandemic.

Automatic revision:

Since 2018, the salaries of MPs are revised automatically every five years, based on the cost inflation index.

Why not the other options?

  • ✗The President does not fix the Prime Minister's salary.
  • ✗The Cabinet cannot decide its own salaries without a law.
  • ✗The Finance Commission deals with Centre-State financial relations.

Quick tip

Remember: Salaries of the PM and ministers = determined by Parliament by law (Article 75(6)).
